What PermitBird is

PermitBird screens a described project against the compiled US Army Corps of Engineers nationwide permit ruleset (91 FR 768, effective 2026-03-15) and tells you which permits could authorise it, whether a pre-construction notification is triggered, and which regulatory layers it could not check.

The clause that matters

A determination is a screening result, not legal advice, not a jurisdictional determination and not an authorisation. Only a Corps district can confirm that a nationwide permit authorises your work. You must verify every determination with the relevant district before you rely on it, and before any work begins in waters of the United States.

Two layers are not yet compiled: the regional conditions each of the 38 districts adds, and the Clean Water Act Section 401 certification each state, tribe and territory issues. Either can narrow, condition or remove a nationwide permit. Every determination lists these as coverage gaps. A verdict that looks favourable federally can still be unavailable once those layers are applied.

Accuracy and the ruleset

Every threshold the engine applies is read from the compiled ruleset and carries its source. We do not infer or interpolate a regulatory condition to fill a gap: where we hold no transcribed limit the engine returns an explicit null rather than a guess. We take care to compile accurately, but we do not warrant that the ruleset is complete or current, and the Corps may modify permits during a cycle.

Subscriptions and cancellation

Pro is billed through Stripe on a recurring basis until cancelled. You can cancel at any time from the billing portal, which opens Stripe's own subscription management. Cancelling stops future charges and your key reverts to the free allowance at the end of the paid period. We do not refund part-used periods as a matter of course, but if the service did not do what this page says it does, write to us and we will sort it out.

Your API key is derived from your subscription, so it stops granting Pro access once the subscription is no longer active. Keep your key private: anyone holding it can spend your allowance.

Acceptable use

Do not attempt to circumvent the rate limits, resell the API as your own determination service, or present our output as a Corps authorisation. The compiled ruleset is derived from public federal documents; our compilation, wording and interfaces are ours.

Liability

The service is provided as is. To the extent the law allows, we are not liable for indirect or consequential loss, including project delay, enforcement action or mitigation cost, arising from reliance on a determination that was not verified with the relevant district. Our total liability is limited to the amount you paid us in the twelve months before the claim. Nothing here excludes liability that cannot lawfully be excluded.

Changes

We may update these terms. Continued use after a change means you accept the updated version, and the date at the top of this page tells you when it last changed.
