VerifiedNWP 27: Aquatic Ecosystem Restoration, Enhancement, and Establishment Activities
Activities in waters of the United States associated with the restoration, enhancement, and establishment of tidal and non-tidal wetlands and riparian areas, the restoration and enhancement of non- tidal rivers and streams and their riparian areas, the restoration and enhancement of other non-tidal open waters, and the restoration and enhancement of tidal streams, tidal wetlands, and tidal open waters, provided those activities result in net increases in aquatic ecosystem functions and services.
Acreage limit
The 2026 rule states no acreage limit for NWP 27. Eligibility turns on the activity description in the rule text and the general conditions that apply, not on a numeric cap.
The 2026 rule contains no notification clause for this NWP. Compensatory mitigation is not required because activities must result in net increases in aquatic ecosystem functions and services.
Pre-construction notification: Not required
NWP 27 carries no notification clause in the 2026 rule. Activities authorised solely under this permit do not need to file a PCN under general condition 32.
